TERMS AND CONDITIONS

FOR HOME CARE SERVICES SWITCH PROGRAM

 

1          PREAMBLE

1.1       Mercy Health Home Care (Mercy Aged and Community Care Ltd ACN 088 254 460 ABN 77 191 901 062) wishes to offer a Switch Reward to eligible clients who switch their home care services to Mercy Health from another provider (the Switch Reward Program).

1.2       A client is eligible for the Switch Reward if the client at any time during the Switch Reward Period:

(a)        has a Home Care Agreement under the Aged Care Act 1997 (Cth) with an approved provider other than Mercy Health; and

(b)        enters into a new Home Care Agreement with Mercy Health by signing a new home care agreement.

1.3       The Switch Reward is offered on these terms and conditions and any additional terms and conditions published by Mercy Health Home Care from time to time.

2          DEFINITIONS

2.1       Switch Reward means the provision of a Coles Group & Myer Gift Card or a Woolworths WISH Gift Card valued at $250.00.

2.2       Switch Reward Period means the period between 9:00am on 1 May 2024 and 11:59pm on 31 July 2024.

3          REDEMPTION PROCESS

3.1       To redeem the Switch Reward a client must initiate the switch of their home care services to Mercy Health by contacting their local Mercy Health Home Care office within the Switch Reward period.

3.2       A client must provide proof of their current home care arrangement with another Home Care provider and change their provider to Mercy Health Home Care.

3.3       If the client meets the eligibility requirements for the Switch Reward Program, Mercy Health will post the Switch Reward to the street address or post office box listed in the client’s home care agreement.

4          LIMITATION OF LIABILITY

4.1       Mercy Health shall not be liable for any loss or theft of the Switch Reward, except where such liability cannot be excluded by law.

4.2       Mercy Health does not accept responsibility for unsuccessful delivery of a Switch Rewards resulting from postage failure of any kind.

5          GENERAL

5.1       Benefits arising from participation in the Switch Reward Program are non-transferable and may not be exchanged for cash or any other alternative benefit.

5.2       Mercy Health Home Care may amend or revoke these terms and conditions at any time.  While Mercy Health Home Care will make reasonable attempts to give you notice of any amendment or revocation of these terms and conditions, it is not required to do so and may alter or revoke the Switch Reward Program at any time.

5.3       Upon participating in the Switch Reward program, the client agrees and consents to the further terms and conditions from:

(a) the Coles Group and Myer: https://corporateservices.giftcards.com.au/CMS/Page/TermsandConditions; and

(b) the Woolworths Group: https://giftcards.woolworths.com.au/wish/p/wish0001

5.4       These terms and conditions shall be governed by and construed in accordance with the laws of Victoria and any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
